BIMKraft Terms of Service

1. Agreement to Terms

By using BIMKraft ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use our software.

2. License Grant

2.1 Trial License

  • You may use BIMKraft free of charge for 30 days from first installation ("Trial Period")
  • The Trial includes full access to all features
  • No credit card required to start the trial
  • Trial automatically expires after 30 days

2.2 Paid License

Upon payment, you are granted:

  • A non-exclusive, non-transferable license to use BIMKraft
  • Installation rights on up to 3 machines per license (Phase 2 online validation)
  • Access to all current features and tools
  • Free software updates during your subscription period

3. Subscription Terms

3.1 Subscription Plans

  • Monthly Subscription: €12 per month, billed monthly, auto-renewal
  • Annual Subscription: €99 per year, billed annually, auto-renewal

3.2 Billing

  • Subscriptions are billed in advance
  • Payment is due at the start of each billing cycle
  • We use Stripe for secure payment processing
  • All prices are in Euros (€) and include applicable VAT

3.3 Auto-Renewal

  • Subscriptions automatically renew unless you cancel
  • You will be charged at the then-current rate
  • We will notify you of price changes 30 days in advance
  • Cancel anytime through your account dashboard or by contacting support

3.4 Cancellation

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • No partial refunds for unused time
  • You retain access until the end of your paid period

##4. Refund Policy

4.1 30-Day Money-Back Guarantee

  • Full refund available within 30 days of first purchase
  • Request refund via email to support@bimkraft.de
  • No questions asked, no need to provide a reason
  • Refunds processed within 5-7 business days

4.2 After 30 Days

  • No refunds for renewal charges
  • Technical issues: We'll work with you to resolve problems before considering refunds
  • Pro-rated refunds may be offered at our discretion for exceptional circumstances

5. Acceptable Use

5.1 Permitted Use

  • Use BIMKraft for commercial and personal projects
  • Install on machines you own or control
  • Use in compliance with Autodesk Revit license terms

5.2 Prohibited Use

You may NOT:

  • Share your license key with others
  • Reverse engineer, decompile, or disassemble the Software
  • Remove or alter any copyright notices or proprietary marks
  • Use the Software for illegal purposes
  • Attempt to circumvent license validation
  • Resell or sublicense the Software

5.3 License Violations

  • We reserve the right to terminate licenses used in violation of these terms
  • No refund will be provided for terminated licenses
  • You may be held liable for damages resulting from unauthorized use

6. Intellectual Property

6.1 Ownership

  • BIMKraft and all related IP are owned by Maria Simon / BIMKraft.de
  • These Terms do not grant you ownership of the Software
  • You receive only a license to use the Software as specified

6.2 Your Content

  • You retain all rights to Revit projects created using BIMKraft
  • We do not claim ownership of any models, drawings, or data you create
  • You grant us permission to use anonymized usage data to improve the Software

7. Data Collection & Privacy

7.1 Data We Collect

  • Email address (for license delivery and support)
  • License key validation data (activation date, machine ID)
  • Payment information (processed by Stripe, not stored by us)
  • Anonymous usage statistics (feature usage, error reports)

7.2 How We Use Your Data

  • Deliver and manage your license
  • Provide customer support
  • Improve product features and performance
  • Send important service announcements (opt-out available for marketing)

7.3 GDPR Compliance

  • You have the right to access, modify, or delete your data
  • Request data export or deletion at privacy@bimkraft.de
  • We comply with EU General Data Protection Regulation (GDPR)

7.4 Data Storage

  • Data stored on secure servers (Supabase, EU region)
  • Encrypted in transit and at rest
  • Retained only as long as necessary for service provision
  • Deleted within 30 days of account closure

8. Software Updates

8.1 Updates Included

  • All updates and bug fixes during your subscription period
  • New features added to the Software
  • Security patches and performance improvements

8.2 Update Delivery

  • Updates delivered automatically via your license key
  • No additional charge for updates during active subscription
  • Major version upgrades included (e.g., 1.x to 2.x)

9. Support & Maintenance

9.1 Support Channels

  • Help with installation and activation
  • Bug reports and troubleshooting
  • Feature usage guidance
  • Compatibility questions

9.3 Out of Scope

  • Custom development or consulting services (available separately)
  • Training beyond provided documentation
  • Revit-specific questions (contact Autodesk)
  • Third-party software issues

10. Warranties & Disclaimers

10.1 Limited Warranty

  • We warrant that BIMKraft will perform substantially as described
  • Warranty period: Duration of your active subscription
  • Remedy: We will fix bugs or refund your purchase (at our discretion)

10.2 Disclaimer

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • UNINTERRUPTED OR ERROR-FREE OPERATION

Use at your own risk. Always maintain backups of your Revit projects.

11. Limitation of Liability

11.1 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

11.2 Excluded Damages

WE ARE NOT LIABLE FOR:

  • Loss of data, projects, or work product
  • Lost profits or business opportunities
  • Indirect, incidental, or consequential damages
  • Damages resulting from third-party actions

11.3 Critical Use

BIMKraft is not designed for use in safety-critical systems or where failure could cause death, injury, or environmental damage. You assume all risk for such use.

12. Termination

12.1 Termination by You

  • Cancel subscription anytime via account dashboard
  • Effective at end of current billing period
  • No early termination fees

12.2 Termination by Us

We may terminate your license if you:

  • Violate these Terms of Service
  • Engage in fraudulent activity
  • Abuse or threaten our staff
  • Fail to pay subscription fees

12.3 Effect of Termination

  • You must stop using the Software
  • Your license key will be deactivated
  • No refund for remaining subscription period (unless we terminate without cause)
  • Data deletion within 30 days (unless you request preservation)

13. Changes to Terms

13.1 Modification Rights

  • We reserve the right to modify these Terms at any time
  • Changes effective 30 days after notification
  • Notification via email to your registered address
  • Continued use after changes constitutes acceptance

13.2 Opting Out

  • If you disagree with changes, cancel your subscription before effective date
  • No refund for current period if you opt out due to Terms changes

14. Governing Law & Disputes

14.1 Governing Law

  • These Terms governed by laws of Germany
  • Jurisdiction: Courts of [Your City/Region], Germany
  • EU consumers retain protections under local consumer law

14.2 Dispute Resolution

14.3 Class Action Waiver

  • Disputes resolved individually, not as class actions
  • No consolidation of claims with other users
  • (Does not apply where prohibited by law)

15. Miscellaneous

15.1 Entire Agreement

  • These Terms constitute the entire agreement between you and BIMKraft.de
  • Supersedes all prior agreements or understandings
  • No oral modifications

15.2 Severability

  • If any provision is found invalid, remaining provisions continue in effect
  • Invalid provision modified to reflect original intent if possible

15.3 No Waiver

  • Failure to enforce any right does not waive that right
  • Waiver must be in writing to be effective

15.4 Assignment

  • You may not assign this license without our written consent
  • We may assign our rights and obligations freely

15.5 Force Majeure

  • Neither party liable for delays caused by circumstances beyond reasonable control
  • Includes natural disasters, war, pandemics, government actions
